SGMsoft LLC (“SGMsoft,” “we,” “us”) is responsible for personal information processed for the purposes described in this policy and is the controller where that term applies. Our mailing address is 440 N Barranca Ave, #4985, Covina, CA 91723, United States.
This policy covers sgmsoft.com and company correspondence arising from this website. Processing carried out under separate customer agreements is governed by the applicable agreement and privacy notice. Other websites you choose to visit have their own privacy policies.
2. Information we collect
- Information you provide. If you email or write to us, we receive your contact details, such as your name, email or postal address, company, and the contents of your message, including any attachments. Please send only information needed for your inquiry.
- Technical information. Our hosting and content delivery provider, Netlify, processes information needed to deliver and protect the website. This may include IP address, requested URL, request time, browser and device information, referrer information when sent by your browser, and security or error logs.
- Privacy request information. If you exercise your rights, we process the information needed to identify the relevant records, verify your identity where required, respond, and document our handling of the request.
We receive this information directly from you, your browser, or the providers that deliver the website and our email. This website does not ask for payment information, government identifiers, account credentials, or precise geolocation, and does not access your device’s location. Sending us information is voluntary; we may be unable to respond without an email or postal address.
3. Why we use information
We use personal information only for relevant business purposes. Where the EU or UK GDPR applies, the legal bases are:

- Service providers: Netlify for hosting, content delivery, and security, and providers of our email and business IT systems for company correspondence. Their access is limited by their role and applicable contractual requirements.
- Our personnel and professional advisers: authorized team members who handle inquiries, and legal or other advisers where needed to advise us or protect our rights.
- Authorities and legal recipients: when necessary to meet a legal obligation, respond to valid legal process, or protect people, rights, and systems.
- Business successors: if necessary as part of a merger, acquisition, or transfer of business assets, subject to applicable confidentiality and data protection requirements.
We do not sell personal information, share it for cross-context behavioral advertising, or disclose it to third parties for their own direct marketing through this website.
5. International transfers
SGMsoft is based in the United States and works with an international team and service providers. Information may be processed in the United States and other countries where our authorized personnel and providers operate, whose laws may differ from those in your country.
Where applicable law requires safeguards for a transfer, we use an appropriate legal mechanism, such as an applicable adequacy decision or standard contractual clauses with any required UK or Swiss adaptations and supplementary safeguards. You can contact us to ask about the safeguards relevant to your information or request a copy, subject to necessary redactions. Visiting this website does not constitute consent to an international transfer.
6. Retention and security
We keep information only as long as needed for the purpose for which it was collected, including applicable legal, accounting, and dispute-resolution requirements. We determine retention using these criteria:
- Company inquiries: the time needed to respond, complete any follow-up, and maintain a relevant business relationship. Where correspondence is needed for a legal obligation or claim, the applicable retention requirement or limitation period also applies.
- Technical and security records: the time needed to deliver the site, troubleshoot failures, and investigate security events, subject to the hosting provider’s applicable log and backup retention settings.

We may request proportionate verification where required, but please do not send an identity document unless we ask for it through a suitable channel. An authorized agent may act for you with appropriate proof of authority.
We respond within the period required by applicable law, generally within one month for EU and UK requests and 45 days for requests under applicable US state privacy laws, subject to permitted extensions. We will explain any extension or refusal and available appeal rights. Requests are normally free; any legally permitted fee or refusal for an excessive or unfounded request will be explained.
If your request is denied and you have a right to appeal, reply to our decision or email us with the subject “Privacy appeal.” We will review the decision and respond within the applicable legal period. You may also complain to your local regulator, including an EEA data protection authority, the UK Information Commissioner, the Swiss FDPIC, or your state attorney general. You do not have to contact us before exercising a statutory right to complain.

Where the California Consumer Privacy Act, as amended by the California Privacy Rights Act, applies, the information in Sections 2–6 describes our categories of information, sources, purposes, recipients, and retention criteria for this website. These categories are identifiers (such as email and IP address), internet or network activity (technical request records), professional information you provide, and the contents of your correspondence.
We disclose these categories only as needed to the recipients and for the business purposes in Section 4. We do not sell them or share them for cross-context behavioral advertising, and do not use sensitive personal information to infer characteristics about you. This website does not offer financial incentives for personal information.
